Welcome to The Salty Depths! These Terms and Conditions ("Terms") govern your use of our website located at www.thesaltydepths.us (the "Website") and any purchases made from our online store. The Website is owned and operated by The Salty Depths ("we," "us," or "our"), operating out of Panama City, Florida.

By accessing our Website, purchasing our products, or engaging with our custom order services, you agree to be bound by these Terms, including all policies referenced herein. If you do not agree to all of these Terms, you are prohibited from using this Website or purchasing our products.

1. Intellectual Property Rights

All original designs, artwork, illustrations, product names, logos, text, graphics, images, and digital content displayed on this Website—including but not limited to our custom beach-themed stickers, vinyl decals, apparel designs, and accessory layouts—are the exclusive property of The Salty Depths and are protected by United States and international copyright, trademark, and intellectual property laws. You may not reproduce, duplicate, copy, sell, or exploit any portion of our designs or website content without express written permission from us.

2. E-Commerce Terms & Sales Tax

By placing an order, you represent that you are at least the age of majority in your state or province of residence. We reserve the right to refuse service, limit order quantities, or cancel orders at our sole discretion.

Because we operate out of Panama City, Florida (Bay County), all orders shipped to a Florida address are subject to applicable Florida state sales tax and Bay County discretionary local option surtaxes, which will be calculated and displayed at checkout.

3. Product Variations & Application Disclaimers

We make every effort to display the colors, textures, and details of our stickers, decals, keychains, shirts, hoodies, hats, and souvenirs as accurately as possible.

Apparel & Accessories: Due to variations in digital displays, monitor calibrations, and the manufacturing process of custom apparel, actual physical colors, fabric shades, and graphic alignments may vary slightly from online images.
Vinyl Decals & Stickers: Our vinyl decals are crafted from high-quality, weather-resistant materials intended for clean, smooth, non-porous surfaces. Proper surface preparation and installation are entirely the responsibility of the consumer. The Salty Depths is not liable for any damage to personal property—including but not limited to vehicle paint, clear coats, windows, laptops, or water bottles—resulting from the application, presence, or removal of our products. Decals and stickers that are damaged during user installation are not eligible for replacement or refund.

4. Shipping, Delivery, and Risk of Loss

All physical items purchased from our Website are made pursuant to a shipment contract. This means that the risk of loss, damage, and title for such items pass to you immediately upon our delivery of the package to the shipping carrier (e.g., USPS, UPS). We are not responsible for packages delayed by the carrier, damaged in transit, or marked as "Delivered" by the carrier but stolen from your property or porch.

5. Charitable Fundraising & Donations

From time to time, The Salty Depths hosts fundraising campaigns where a portion or all of the profits from specific items are donated to a designated 501(c)(3) non-profit organization.

Complete Transparency: For every fundraising product, the specific beneficiary charity and the exact percentage or dollar amount of proceeds to be donated will be clearly disclosed on that item's product page.
Non-Deductibility for Customers: Under IRS and state regulations, because you are receiving a commercial physical good (e.g., a shirt, keychain, or souvenir) in exchange for your payment, your purchase does not qualify as a tax-deductible charitable contribution. The Salty Depths will handle and track all final lump-sum donations directly to the designated non-profit organization.

6. Custom and Personalized Orders

Custom-designed apparel, personalized decals, and bespoke gifts involve dedicated time, meticulous planning, and immediate upfront material expenses on our end. Because custom items are tailored specifically to your requests, they are subject to the following rules:

Time and Processing Constraints: Custom orders require a standard processing timeframe to ensure high-quality craftsmanship. Standard turnaround times are outlined at the time of your order, and production timelines do not begin until full payment or the required deposit has been settled.
Changes and Revisions: Changes to a custom order design or specification must be submitted within 72 hours of placing the order. Once the 72-hour window has passed, or if production has already commenced using upfront materials, no further alterations can be made.
Next-Day / Rush Delivery Requests: If you require an expedited timeline or a next-day turnaround, you must contact us directly before purchasing to confirm availability. Next-day and heavily expedited custom orders are subject to availability and will incur additional rush processing fees to cover rapid material sourcing and priority labor.
Non-Refundability: All custom, personalized, or made-to-order items are completely non-refundable, non-returnable, and non-exchangeable unless a structural defect or spelling error was made entirely on our part.

7. Limitation of Liability

In no event shall The Salty Depths, our owners, employees, or affiliates be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or consequential damages of any kind—including lost profits, lost revenue, or property damage—arising from your use of our website or any products procured through it.

8. Governing Law

These Terms and Conditions and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any legal actions or proceedings arising from these Terms must be filed exclusively in the state or federal courts located in Bay County, Florida.

Custom Order Terms and Conditions

Custom Orders: The Fine Print

By approving a custom quote and design proof with The Salty Depths, you agree to the following terms and conditions.

1. Why We Require Deposits (The "Behind the Scenes")

Custom orders are not "off-the-shelf" products. Every order involves significant upfront investment on my end: purchasing specific vinyl/apparel stock, machine calibration, digital file setup, and dedicated studio time reserved exclusively for your project. Because of this, all custom orders require a 50% non-refundable deposit once the quote is approved. This secures your materials and your production slot.

Note: You may pay 100% upfront if you prefer to finalize the transaction immediately.

2. Artwork Requirements

No Design Services: The Salty Depths is a production studio, not a graphic design firm. You must provide your own final artwork. We do not provide graphic design, logo creation, or image editing services. All files must be client-provided.
File Specs: Files must be 300 DPI and in PNG format with a transparent background.
The "WYSIWYG" Rule: We do not upscale or "fix" low-resolution images. If your digital proof looks blurry or pixelated, your final product will look the same. If you need help preparing your files, please check out tutorials for Canva or Photopea on YouTube.

3. Turnaround Times & "The Clock"

The Launch Point: Your turnaround time begins only when both conditions are met:
1. Your final digital proof is explicitly approved.
2. Your 50% deposit (or full payment) is received.
Communication Lag: If we are discussing your project and you need it by a specific date, please be aware that the clock does not start until the proof is approved. If you take 3 days to approve a proof, those 3 days are deducted from your production window. If that delay pushes your deadline into a rush window, rush fees will apply.

4. Rush & Emergency Orders

Because our studio is handmade and human-powered, production takes time. We offer two tiers of expedited service for when you're in a pinch:

Standard Rush (Less than 72 hours): Orders requiring a turnaround of less than 3 business days from proof/deposit approval incur a Rush Order Fee equal to 50% of the total order. This fee must be paid in full with your deposit.
Emergency/Next-Day Service (Less than 48 hours): We occasionally accept next-day emergency orders, depending on current studio capacity. These are extremely disruptive to our planned production and require immediate attention, often outside of normal operating hours. Emergency Next-Day orders incur a Rush Order Fee equal to 100% of the total order. Please inquire regarding availability before assuming we can accommodate a 48-hour turnaround.
